Terms and conditions
1. Introduction
These Terms and Conditions govern the provision of window furnishing products and services provided by Home Improvement Collective Pty Ltd Trading As "Sunset Blinds" ("we," "us," or "our"). By using our services, you agree to comply with and be bound by these terms.
2. Definitions
Client: Refers to property managers, property owners, and/or agents engaging our services.
Products: Made-to-measure window furnishings, including blinds, shutters, and other window furnishings.
Services: Any installation, repair, consultation, or other work provided by our team.
3. Orders and Acceptance
Orders are considered accepted upon receipt of confirmation or work order from our clients. We reserve the right to decline any order or service request based on availability or other business considerations.
4. Quotation and Pricing
All quotations provided are valid for 14 days and may be subject to adjustments based on changes in requirements. Pricing excludes GST and delivery charges unless otherwise specified.
5. Payment Terms
Payment is due by the last day of the month invoice for property agents and 14 days from completetion of works for property owners. Late payments may incur additional charges or interest as specified. We reserve the right to recover any costs associated with collecting unpaid invoices, including legal fees, collection agency fees, and other expenses incurred during the recovery process. In the event that the agent or agency is unable to collect payment from the landlord, they agree to provide us or any appointed collection service with the necessary landlord information to facilitate direct collection of the payment. We accept cash, card (fees apply) and bank trasnfer.
6. Installation and Delivery
Our team will coordinate installation based on availability and the schedule agreed upon with the client. While we aim to meet all delivery and installation timelines, delays due to unforeseen circumstances are not our responsibility.
7. Warranty and Repair Policy
Our products come with a 12 months warranty covering manufacturing defects. Repairs to existing window furnishings are subject to a site visit to assess repairability and are charged separately. If a repair has been completed on a product where a replacement was advised, that repair will not be covered under warranty. Final determination of warranty coverage rests with Home Improvement Collective T/A Sunset Blinds, and we reserve the right to decide whether a claim is valid.
8. Cancellations and Changes
Cancellations are only accepted prior to job approval or the receipt of a work order. Once a job has been approved or a work order received, cancellations are not permitted, and the client will be responsible for the full quoted price. Changes to orders or schedules may incur additional charges, especially if materials have been custom-ordered or work has already begun. Examples of additional charges may include restocking fees, rescheduling fees, or additional labor costs due to last-minute adjustments.
9. Liability and Indemnity
While we ensure quality in all products and services, Home Improvement Collective Pty Ltd Trading As "Sunset Blinds" is not liable for any indirect, incidental, or consequential damages arising from the use of our products or services. Clients agree to indemnify and hold us harmless against any claims arising from third-party products or installations.
10. Limitation of Service
Repairs or installations for window furnishings installed by other companies are performed on a case-by-case basis and are not guaranteed. Availability for these services is based on assessment and may incur additional charges. We are not responsible if the same issue reoccurs, if another part breaks during the repair process, or if any additional parts fail after the repair has been completed. Should additional parts break during the repair, further charges will apply to repair or replace those parts as needed.
11. Privacy Policy
We are committed to protecting client privacy and handling personal data responsibly. Personal information collected will only be used for fulfilling orders, providing services, and improving customer experience. For full details, refer to our Privacy Policy.
12. Dispute Resolution
In the event of any dispute, parties agree to first attempt mediation before pursuing other legal remedies. Our jurisdiction for any unresolved legal matters is the state of New South Wales.
13. Changes to Terms
Home Improvement Collective Pty Ltd Trading As "Sunset Blinds" reserves the right to amend these Terms and Conditions as necessary. Updates will be communicated on our website and will take effect upon publication.
